Item 7.01 Regulation FD Disclosure.
On March 3, 2021, in connection with DraftKings Inc.’s (the “Company”) previously disclosed lawsuit, In Re: Daily Fantasy Sports Litigation (Multi-District Litigation), the Company and the plaintiffs (other than a small set of plaintiffs who are family members of individuals who have registered accounts with the Company) filed a joint motion for preliminary approval of a proposed settlement in the U.S. District Court for the District of Massachusetts (the “Court”). The settlement agreement is subject to preliminary and final approval by the Court.
